Tyson Foods defeated an appeal by the maker of Parks' sausages, which challenge’s Tyson’s use of the phrase "Park's Finest" to describe one of its hot dog lines.
The 3rd U.S. Circuit Court of Appeals in Philadelphia on July 6 upheld a federal judge's May 2016 dismissal of trademark infringement and false advertising claims by Parks LLC, which said consumers might be confused that the Park’s Finest line were produced by Parks LLC, Reuters reported.
In the 2016 ruling, the judge stated that “a reasonable trier of fact could not find that defendants use of the Park’s Finest name on their packaging for their product or their advertisements has a tendency to deceive a substantial portion of their intended audience.
Tyson’s Park’s Finest line was introduced in 2014. Parks LLC was founded in 1950.
