The Michigan Supreme Court said it would not consider if the state's program regulating 200 livestock and poultry farms violated the Clean Water Act.
Last year, a state appeals court had ruled that Michigan was allowing farms too much leeway to adopt their own rates to spread manure.
The high court voted 5-2 to not hear the state's appeal.
